RETURNS AND PAYMENT DISPUTES

Returns and refunds are handled under our Returns & Refunds Policy.

For voluntary returns, please contact us before sending a product back. We provide the return address and instructions when the return is approved. Statutory cancellation and other mandatory consumer rights do not require our prior approval; we provide return instructions promptly when those rights are exercised.

If you experience an issue with an order, please contact contact.tinypets@use.startmail.com so we can help. Nothing in these Terms requires you to waive or delay any legal right to raise a payment dispute or seek another remedy.

OVERVIEW

Welcome to GetTinyPets, operated by Luiz Gustavo Ferreira Dos Santos through Theinfiny.com. The terms “GetTinyPets,” “we,” “us,” and “our” refer to this seller operating under the GetTinyPets brand.

We offer pet products, including a dog drying bag, together with the website, content, shopping tools, and related services collectively referred to as the “Services.”

Our store is hosted on Shopify, which provides the e-commerce platform used to operate the store.

These Terms govern use of the Services and purchases from us. They should be read together with the applicable product information, order details, and Returns & Refunds Policy. Our Privacy Policy explains how personal information is handled.

By placing an order, you agree to the purchase terms disclosed before checkout. Use of the website does not replace any separate consent or express agreement required by law.

Nothing in these Terms excludes mandatory consumer rights.

SECTION 1 — ELIGIBILITY, ACCESS AND ACCOUNT

To place an order, you must be legally capable of entering into a binding contract under the law applicable to you. Minors may use the website only with the permission and supervision of a parent or legal guardian.

Provide accurate and current contact, billing, shipping, and payment information, and use only payment methods you are authorized to use.

Keep your account credentials secure and notify us promptly of suspected unauthorized access. You are responsible for your own authorized account activity, subject to applicable law. This does not make you responsible for security failures attributable to us or our service providers.

You may not sell or transfer your customer account to another person.

SECTION 2 — PRODUCTS, USE AND ACCURACY

We aim to describe products accurately, including their materials, dimensions, compatibility, included components, and intended use. Screen settings may affect how colors appear. These variations do not remove your right to receive goods that match their description.

Drying results can vary with the dog's size, coat, starting moisture level, and the equipment and settings used. Specific performance claims must be understood in the context and conditions in which they are stated.

Product descriptions, availability, and offers may change for future purchases. Changes do not alter an accepted order or remove binding representations made before that purchase.

Pet product use and supervision

Our dog drying bag is a grooming accessory intended to assist with drying dogs after bathing. Use it only for the animals, sizes, and purposes identified in the supplied instructions.

An adult must supervise the dog throughout use. The bag does not replace supervision, and any reference to reduced handling or convenient drying does not mean the animal may be left unattended.

Follow the instructions and warnings supplied with the bag and with any dryer used alongside it. In particular:

• Use only compatible equipment and the settings permitted by the relevant instructions.

• Keep the dog's head unobstructed and ensure the fit does not restrict breathing or cause discomfort.

• Do not block required airflow or use excessive heat.

• Monitor the dog and the temperature throughout drying; stop if the dog becomes distressed, overheated, or has difficulty breathing.

• Do not use damaged equipment or allow the dog to chew the bag, hose, or electrical cables.

• Follow the care and cleaning instructions before storing or reusing the product.

Do not assume the bag automatically regulates the temperature of an external dryer. If the instructions do not clearly establish compatibility or suitable settings, contact us before use.

Damage caused by misuse or failure to follow supplied instructions may affect a claim where that damage caused the issue and the law permits it. It does not automatically cancel all return, refund, or warranty rights.

Veterinary information

Our dog drying bag is a grooming accessory, not a veterinary treatment. General content on this website is not a diagnosis or a substitute for advice from a veterinarian. We do not promise that the product will treat illness or eliminate anxiety, skin problems, or other medical conditions.

SECTION 3 — ORDERS, ACCEPTANCE AND CANCELLATIONS

Placing an order is an offer to purchase the selected goods. Acceptance occurs when we confirm acceptance and payment has been successfully processed. A payment authorization alone does not confirm acceptance.

We may decline an order for a legitimate reason, such as unavailable stock, failed payment, suspected fraud, an unsupported delivery destination, or a legal restriction. We will notify you and refund any payment taken for goods we will not supply.

Review your order before submitting it. Contact us promptly if you need to change or cancel it. Fulfilment may already have begun, so we cannot promise that a requested change will be possible. This does not limit statutory cancellation rights.

We will not substitute a materially different product or change an accepted price without your agreement.

Purchases are intended for personal or household use. Contact us before placing an order intended for resale or other commercial supply.

SECTION 4 — PRICING, TAXES AND BILLING

Prices and promotions may change for future orders. The agreed price and currency for your purchase will be shown at checkout and in the order confirmation.

Prices include taxes where required by applicable law. Any delivery charges, taxes collected at checkout, and other charges payable to us will be disclosed before you commit to the purchase. Optional paid extras require your agreement.

For international orders, customs duties or import charges may apply. If these are not collected by us, we will disclose that fact before purchase. You are responsible only for charges lawfully payable by you; this clause does not transfer taxes or obligations that legally belong to us.

Separate promotional terms apply where clearly disclosed before purchase. They do not override mandatory rights or an offer already accepted.

Keep your purchase and account information current so we can process the order and contact you about it.

SECTION 5 — SHIPPING, DELIVERY, OWNERSHIP AND RISK

Available delivery options, charges, and estimated timeframes are disclosed before purchase. An estimate is not a guaranteed date unless we expressly agree to one, but our contractual and statutory delivery obligations still apply.

Carriers, customs, weather, and other events may affect delivery. If an issue arises, we will take reasonable steps to assist and comply with any applicable right to cancel or obtain a refund for late or failed delivery.

Where we arrange delivery, the risk of loss or damage remains with us until you, or a person you designate other than the carrier, physically receive the goods. Different rules may apply if you independently appoint a carrier that we did not offer, where permitted by law.

Ownership passes when payment has been received and the goods have been delivered, subject to any mandatory legal rule.

If tracking shows delivery but you have not received the parcel, contact us promptly. We will investigate with the carrier and may ask for reasonable supporting information. A tracking status does not, by itself, remove your legal rights.

Optional shipping or package protection is not required to exercise rights for delivery problems for which we are legally responsible.

SECTION 6 — INTELLECTUAL PROPERTY

Website content, including text, images, designs, and brand materials, is owned by us or used with the permission of the relevant rights holders, except where otherwise indicated.

You may browse the website and keep copies of your order information and policies for personal use. Commercial reproduction or use of protected content requires permission unless an applicable legal exception allows it.

The GetTinyPets name, logo, and related brand identifiers may be protected by intellectual property law. Shopify's name and logo, and other third-party brands, belong to their respective owners. Nothing here claims that a mark is registered where it is not.

SECTION 7 — OPTIONAL TOOLS

We may make third-party tools available through the Services. Independent third-party tools may have their own terms and privacy information, which you should review before using them.

We do not control every feature of independent tools or guarantee their uninterrupted availability. This does not exclude responsibilities we have for tools or services supplied as part of our own contractual obligations.

SECTION 8 — THIRD-PARTY LINKS

The website may link to independent third-party websites. Their content and practices are controlled by their operators.

A link does not, by itself, mean we endorse every statement or service on the linked website. Your dealings with an independent third party may be subject to its terms. Our own legal responsibilities remain unaffected.

SECTION 9 — SHOPIFY RELATIONSHIP

Our store is powered by Shopify. Purchases from this store are made directly with Luiz Gustavo Ferreira Dos Santos, trading as GetTinyPets.

Shopify supplies the commerce platform and is not the seller of our products. We remain responsible for our sales, order support, and obligations as the seller.

This section does not exclude any rights or obligations that apply independently to Shopify under applicable law.

SECTION 10 — PRIVACY

Our handling of personal information is explained in the Privacy Policy.

Shopify may also process information in providing its platform and related services, as described in Shopify's Privacy Policy.

Where law requires consent for particular processing or communications, agreement to these Terms does not replace that consent.

SECTION 11 — USER CONTENT, REVIEWS AND COMMENTS

If you submit a review, photo, comment, or other content, you must have the right to share it. Reviews should reflect your genuine experience, and content must not unlawfully disclose someone else's personal information or infringe their rights.

You retain ownership of your content. By submitting it for publication, you grant us a non-exclusive, worldwide, royalty-free license to host, reproduce, format, and display it in connection with our store and related product promotion.

We will not alter a review's meaning or use it misleadingly. Use of personal information remains subject to the Privacy Policy and applicable privacy, consent, and personality rights.

We may moderate content that is unlawful, fraudulent, irrelevant, abusive, or infringes another person's rights. A negative opinion alone is not a reason to suppress a genuine review.

Goods remain subject to applicable legal guarantees and the commercial warranty described in our Returns & Refunds Policy. Nothing in these Terms supplies products without the warranties or conformity obligations required by law.

We take reasonable care in operating the website but cannot promise uninterrupted access or compatibility with every device. Temporary maintenance, updates, or technical problems may affect access.

Any permitted limitation concerning website availability does not remove rights relating to purchased goods or other mandatory protections.

SECTION 16 — LIABILITY

We are responsible for loss or damage for which we are legally liable, including reasonably foreseeable loss caused by a breach of contract or a failure to exercise the care required by law.

Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited, including liability for fraud, death or personal injury caused by negligence, or mandatory obligations concerning defective goods.

Products are supplied for personal and household use. To the extent the law permits, we do not accept liability for business losses arising from commercial use contrary to that purpose.

Your statutory remedies and any commercial commitments we expressly make remain unaffected.

SECTION 17 — RESPONSIBILITY FOR UNLAWFUL USE

You may be responsible under applicable law for loss directly caused by your fraudulent or unlawful use of the Services or infringement of another person's rights.

This section does not require you to indemnify us or Shopify for our own negligence, legal breaches, or matters for which you are not legally responsible.

If a provision is unlawful or unenforceable, it will apply only to the extent legally valid or will be treated as ineffective. The remainder of the Terms continues to apply where the contract can legally continue.

SECTION 19 — WAIVER AND ENTIRE AGREEMENT

A delay in enforcing a right does not automatically waive it.

These Terms, the applicable policies, and the product and order information agreed at purchase form the agreement between you and us. They do not exclude binding pre-contractual information, representations, or statutory rights.

SECTION 20 — ASSIGNMENT

You may transfer contractual rights or obligations only with our agreement, unless the law permits otherwise. We will not unreasonably withhold consent where applicable law requires it.

We may transfer our rights and obligations to another business only in a way that preserves your contractual and statutory rights. We will notify you where the law requires.

The law governing a purchase and the courts with jurisdiction are determined by the applicable rules on contracts, consumer protection, and jurisdiction.

Nothing in these Terms deprives consumers of mandatory protection available under the law of their habitual residence where that protection applies, or requires them to bring proceedings in a foreign court contrary to their legal rights.

Contact us if a dispute arises so we can seek a resolution. This does not prevent you from using any court, payment-provider procedure, regulator, or alternative dispute-resolution route available to you.

For any ongoing service, we will give notice of material changes and obtain agreement where required. Continued browsing alone does not remove existing contractual or statutory rights.
